Retail FAQ

Yes, we love to buy and sell used handguns and long guns. We specialize in the purchase of estate firearms/antique firearms and militaria. We will come to you. Our company is licensed as a secondhand dealer in firearms and has excellent working relationships with local law enforcement property bureaus. We also accept trade-ins when purchasing new firearms and other store items. We have an extensive inventory of pre-owned firearms and accessories.

Yes, a consignment gun is a gun that our shop will sell on behalf of another individual. A person may not want to deal with the process of selling a firearm for a multitude of
reasons. They then bring the gun to us, and we put it up for sale with our inventory or can list it online. The benefit of Baits & Barrels selling your firearm enables the seller to have a better chance of getting their gun sold for a higher price than if they sell it on their own. However, since we are doing the leg work for you (photographing,
listing, auctioning and collecting payment), you pay a fee, generally in the
form of a percentage of the sale price rather than an upfront cost. Consigner
fees vary depending on the type of firearm and its value.

Even when a retiree has the protection of HR-218, he or she may nonetheless be subject to a field investigation or station-house investigation to verify compliance with each requirement of HR-218.

Each licensing jurisdiction has a different purchase procedure. You should refer to the “Issuing Agency” handbook for up-to-date information. All Licensing officers require a “Purchase document” or “voucher” to be obtained prior to the disposition of a Handgun to the individual licensee. Nassau County, NY as of 6/1/21 requires the NICS check to be performed and for the NTN1 number to be listed on the purchase document prior to the issuance of a purchase document. New York State Law’s designation as a “Major Component of a Firearm”

You will provide us with a driver ’s license or other government issued identification with a photo then fill out ATF form 4473 that transmits information to the National Instant Background Check System (NICS), a federal database mandated by the Brady Handgun Violence Prevention Act (known as the “Brady Law”) of 1993, and created by the FBI in 1998. The NICS database is used by gun retailers, known as Federal Firearms Licensees (FFLs), to instantly determine whether a prospective buyer is eligible to buy firearms. Before the sale, a call or e-check is made to the FBI or to other designated agencies to ensure that each customer does not have a criminal record or isn’t otherwise ineligible to make the purchase. Upon submission of your 447 info to the NICS portal, you will receive one of three outcomes: 1. Proceed, 2. Delay, 3. Deny

There can be any number of reasons why an application can be delayed, and it does not always mean that you have been denied for gun ownership. It simply means that the NICS, which is operated by the FBI, needs more information before either approving or denying your application. For example, if your name or information is similar to someone who is prohibited from owning a firearm, then your application may be delayed. Your FFL dealer will inform you when the background check is completed. The NICS is afforded three days to complete its research. If the delay takes too long, you can file an appeal on it, although the FBI recommends waiting 30 days beforehand.A denial means you will not be able to purchase a firearm. If you are still interested in completing the purchase, find out why your application is denied. There is an appeal process for denials, and according to the National Rifle Association (NRA), a significant number of cases result in the decision being ultimately overturned. So, if you think your denial was made in error, it is worth your time to fight it. In cases where you are delayed for no good reason, you may make an application for a UPIN number. More information if available online. Click here for the NICS deny card.

Law Changes FAQ

Attention New York State customers: Effective September 13th, 2023, All Background Checks on ammo & firearms will no longer be processed by the FBI NICS system.

ALL dealers have been officially notified that:

  • Pursuant to Executive Law § 228, New York has been designated a Point of Contact state for the purpose of processing National Instant Background Check (“NICS”) transactions.

TRANSLATION: Commencing on September 13, 2023, all background check requests for firearms, including rifles, shotguns, and ammunition purchases, will be submitted to the New York State Police. FFL & NYS Dealers will no longer submit requests directly to FBI NICS.

New York State Police
NYS NICS Unit

This is a new and unpredictable that will affect firearm, rifle, shotgun, and ammunition purchases in New York. We have received official notification that New York has been designated as a Point of Contact state, in accordance with Executive Law § 228, for processing National Instant Background Check (“NICS”) transactions.

Starting September 13, 2023, the background check requests for firearms, rifles, shotguns, and ammunition purchases will now be directed to the New York State Police instead of the long-standing process performed by the FBI NICS section. Fees paid directly to New York State: AMMUNITION: $2.50 – FIREARMS: $9.50 per transaction *

While we are eager to ensure a seamless transition, we anticipate some uncertainties in the initial stages of this new system. We are currently enrolled and registered with NYS for access to the system, although we currently lack firsthand experience of its operation. On 9-13-2023, dealers are required to submit payment for the processing fee associated with each background check immediately to NYS.gov.

For those purchasing firearms, the procedure for background checks will remain consistent with the familiar forms customers have been using. There is a slight change in the process when it comes to ammunition purchases. Customers will no longer be required to complete a form; dealers will be responsible for submitting customer information to the state for approval before each daily transaction, not per box or per round of Ammo.

Dealers will need to submit the customer’s driver’s license details, as well as specific details about the ammunition being purchased, such as the quantity, caliber, manufacturer’s name, and, if applicable, the serial number to the NYS police portal.

We understand these changes may raise questions, and we are committed to providing you with the most accurate information through our website and social media accounts. Please subscribe to our mailing list and social media accounts for the latest information.

Thank you for your continued trust and support.

Although the law has never been changed by NYS “legislator bodies”, a court decision issued by the United States District Court for the Western District of New York (2nd circuit court of appeals) released a revision. This federal court jurisdiction determined the 7-round law to be arbitrary and unconstitutional. You will find the Law Enforcement directive issued by the Office of Division counsel New York State police below, taken from page 8, section 4 of the amendments made to the NYS Police Guide to the Safe Act.
